SecureStrux, LLC owns and operates the PowerStrux® brand. This Website Privacy Policy (the “Privacy Policy”) explains how SecureStrux, LLC (“SecureStrux,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information through the PowerStrux websites.

This Privacy Policy applies to powerstrux.com and any website, portal, webpage, or online form that we make available through a web browser on a subdomain of powerstrux.com, including resellers.powerstrux.com (collectively, the “Website”).

This Privacy Policy applies only to information collected through the Website and related online interactions. It does not govern information processed locally by PowerStrux software installed in customer-controlled environments. It also does not apply to third-party websites or services that we do not operate, even if the Website links to them.

1. Information We Collect

We may collect information directly from you, automatically when you use the Website, and from other lawful sources.

A. Information You Provide

Depending on how you interact with the Website, you may provide:

Contact and business information, such as your name, business email address, telephone number, company, job title, and professional role.
Inquiry and sales information, such as your product interests, pricing requests, demo requests, free-trial requests, purchasing needs, and messages you send us.
Support information, such as the PowerStrux product you use, a description of your issue, and other information you choose to provide in a support request.
Reseller and portal information, such as reseller application information, company qualifications, account credentials, business opportunities, customer or prospect information submitted through the reseller portal, training activity, and communications with the PowerStrux reseller team.
Transaction and billing information, such as billing contact details, purchase details, payment method, transaction status, and related financial records. Payment-card information may be collected directly by a payment processor, such as Stripe, rather than by SecureStrux. We do not intend to store complete payment-card numbers through the Website.
Marketing preferences, such as whether you want to receive newsletters, product announcements, event invitations, or other marketing communications.
Privacy-request information, such as information needed to process or verify a request to access, correct, delete, or opt out of certain uses of personal information.

Please do not submit passwords, access credentials, classified information, Controlled Unclassified Information, export-controlled information, sensitive system data, audit reports, or other confidential information through a general Website form or ordinary email. If such information is needed to resolve a support matter, contact us first so we can identify an appropriate method for sharing it.

If you submit personal information about another person, you are responsible for having appropriate authority to provide that information and for giving any notice required by applicable law.

B. Information Collected Automatically

When you visit or use the Website, we and our service providers may automatically collect:

Our Opt-Out Preferences page provides additional information about cookies and available controls. You can also use the “Manage Consent” control on the Website to review or change your choices. Blocking some cookies may affect Website features or reseller-portal functionality.

D. Information From Other Sources

We may receive professional contact or business information from:

A PowerStrux reseller, referral source, or business partner;
A person who asks us to contact you;
An event organizer or co-sponsor, where permitted by law and disclosed when the information is collected;
Publicly available professional or business sources; and
Vendors that help us maintain, supplement, or protect our business records.

2. How We Use Information

We may use personal information to:

Operate, maintain, secure, and improve the Website;
Provide requested information, demonstrations, trials, products, training, and support;
Create, authenticate, administer, and protect reseller accounts;
Evaluate reseller applications and manage reseller relationships and opportunities;
Process purchases, payments, renewals, and related business records;
Respond to questions, requests, complaints, and privacy inquiries;
Communicate about products, services, releases, events, and other information that may be relevant to you;
Personalize Website content and user experiences;
Measure Website traffic, advertising, and marketing effectiveness;

A. Service Providers

We disclose information to companies that perform services for us, such as Website hosting, cloud services, customer relationship management, analytics, advertising, email delivery, payment processing, fraud prevention, security, customer support, and professional services. These providers receive information needed to perform their services and are expected to handle it in accordance with their contractual and legal obligations.

B. Resellers and Business Partners

We may disclose information to authorized PowerStrux resellers or business partners when necessary to respond to a request, provide a product or service, manage a business opportunity, support a customer relationship, or conduct an event or promotion that is clearly identified as jointly offered. We do not disclose your personal information to an independent reseller or partner for its own unrelated marketing without authorization or another lawful basis.

C. Professional Advisers

We may disclose information to attorneys, accountants, auditors, insurers, financial institutions, and other professional advisers when reasonably necessary for the services they provide to us.

D. Legal, Security, and Protective Purposes

We may disclose information when we reasonably believe disclosure is necessary to comply with law or valid legal process; respond to lawful requests from courts, regulators, law enforcement, or government authorities; investigate or prevent fraud, security incidents, or unlawful conduct; enforce our agreements; or protect the rights, safety, property, or experience of SecureStrux, our users, or others.

E. Corporate Transactions

If SecureStrux is involved in a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction, personal information may be disclosed or transferred as part of that transaction. A recipient will remain responsible for handling personal information consistently with applicable law and the commitments governing the information.

We may disclose information when you direct us to do so or consent to the disclosure.

SecureStrux does not sell or rent personal information or contact lists for money.

Some state privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough to include the disclosure of cookie identifiers, online activity, general location, or advertising information to analytics and advertising providers, even when no money changes hands. Because we may use analytics, advertising, and marketing technologies on the Website, some of these activities may be treated as a sale, sharing, or targeted advertising under applicable law.

You may use our Opt-Out Preferences page or the Website’s “Manage Consent” control to opt out of applicable advertising or tracking activities. Where required by law, we also process recognized browser-based opt-out preference signals, such as Global Privacy Control, as a request to opt out for the browser or device that sends the signal.

We do not knowingly sell or share the personal information of anyone under 16 years of age.

5. Marketing Communications

You may unsubscribe from marketing emails by using the unsubscribe link in the email or by contacting us at [email protected]. Even if you unsubscribe from marketing, we may continue to send non-promotional communications concerning transactions, accounts, support requests, security, legal notices, or an ongoing business relationship.

6. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide products and services, maintain business and financial records, administer accounts and reseller relationships, resolve disputes, enforce agreements, protect the Website, and comply with legal obligations.

Retention depends on the type of information and the context in which it was collected. For example:

Contact, inquiry, sales, and marketing information may be retained while we maintain a business relationship and for a reasonable period afterward;
Reseller account and portal information may be retained for the life of the account and afterward as needed for security, recordkeeping, and legal purposes;
Transaction and billing records may be retained for the periods required by tax, accounting, contract, and other laws;
Support communications may be retained as needed to resolve issues, improve support, document service history, and protect legal rights;
Cookie and analytics information is retained according to the duration of the applicable cookie or provider setting described through our cookie controls; and

We may delete, anonymize, or aggregate information when it is no longer reasonably necessary to retain it.

Please describe the right you wish to exercise and provide enough information for us to locate the relevant records. We may ask for additional information to reasonably verify your identity, protect your information, and prevent fraudulent requests. Information collected for verification will be used for that purpose.

If we deny a request and applicable law provides an appeal right, you may appeal by emailing [email protected] with “Privacy Request Appeal” in the subject line and explaining why you believe the decision should be reconsidered.

Where permitted by law, an authorized agent may submit a request on your behalf. We may require proof of the agent’s authority and may need to verify your identity directly.

We use sensitive personal information only as reasonably necessary to authenticate users, provide requested services, maintain account and Website security, prevent fraud, and perform other purposes permitted by applicable law. We do not use sensitive personal information to infer characteristics about individuals.

As described in Section 4, we do not sell personal information for money. Our use of advertising and analytics technologies may involve the sale or sharing, as those terms are defined by California law, of identifiers, Internet activity, general geolocation information, and related inferences to or with advertising and analytics providers. California residents may opt out through our Opt-Out Preferences page, the Website’s “Manage Consent” control, or a recognized opt-out preference signal such as Global Privacy Control.

We do not disclose personal information to third parties for their own direct-marketing purposes as those activities are ordinarily understood. California residents with questions concerning California Civil Code Section 1798.83 may contact us using the information in Section 15.

10. Children’s Privacy

The Website is intended for businesses and professionals and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Website. If you believe a child under 13 has provided personal information to us, contact us, and we will take appropriate steps to investigate and delete the information where required.

11. Third-Party Websites and Services

The Website may contain links to websites, applications, or services operated by third parties. Their privacy practices are governed by their own policies, not this Privacy Policy. We encourage you to review their policies before providing information. We are not responsible for the privacy or security practices of third parties we do not control.

SecureStrux is based in the United States, and the Website and its service providers may process and store information in the United States and other locations where they operate. Privacy and data-protection laws in those locations may differ from the laws where you live.

We may update this Privacy Policy to reflect changes in our Website, practices, technologies, or legal obligations. We will post the updated version on the Website and revise the “Last Updated” date. If required by law, we will provide additional notice or obtain consent before a material change applies.

This Privacy Policy should be read together with the Website’s applicable Terms of Use, Disclaimer, Opt-Out Preferences, and other posted policies. If you use PowerStrux software, your use of that software is also governed by the applicable license agreement and related product documentation.
